T-Mobile Non-Compliance Fines

As of 2024, T-Mobile has instituted fines for sending mass messaging SMS campaigns to T-Mobile customers in the US or Canada which violate the terms listed below.

Note: Should any of these fines be incurred through your use of ABC GymSales, they will be passed on to you.

Fines are based on violation levels (tiers), which are described below.

  • Tier 1: Phishing, smishing, and social engineering ($2000 fine).
    • Phishing is a technique used to steal sensitive information, typically usernames, passwords, credit card numbers, etc., via links sent in an email. Smishing is a similar attempt via SMS.
    • Social Engineering is a technique used to manipulate someone into willingly sharing usernames, passwords, credit card numbers, etc., for a legitimate reason.
  • Tier 2: Federally illegal content, including cannabis or CBD references ($1000 fine).
    • The following table provides a list of terms to avoid.

  • Tier 3: All other violations including, but not limited to, sex, hate, alcohol, firearms, and tobacco communications that do not follow state or federal regulations ($500 fine).

    • The following language may also cause filtering:
      • Profanity: offensive language including swear words and offensive slurs.
      • Hate speech: words or phrases that promote hate speech, discrimination, or incite violence.
      • Harassment: terms related to harassment, bullying, or threats.
      • Illegal activities: terms related to illegal activities such as drug trafficking, terrorism, or other criminal actions.
      • Adult content: words or phrases that refer to explicit or adult content, pornography, or sexual services.
      • Spam or scams: terms related to spam, phishing attempts, or fraudulent activities.
      • Sensitive information: certain personal information such as social security numbers, credit cards numbers, or passwords.
      • Violent or graphic content: words associated with violence, gore, or graphic descriptions.
      • Copyright infringement: terms related to pirated content, copyright infringement, or illegal sharing of intellectual property.
